Arty Party

Arty Party represents visual artists in CT, MA, RI, and NH who do it all: from kids party entertainers like face painting pirates to glitter-tattoo-creating-mermaids, to family-friendly adult entertainment like caricatures, airbrush tattoos, paint parties, and more!

SAFETY: The safety of our entertainers, Clients, and event guests is the priority of all safety policies.

Safety Overview
The Client and Arty Party must agree to follow all public health rules and guidelines set by local, state, or federal governments. Both parties agree to act in good faith outside of those guidelines in the interest of public health.

Covid-19 and other Issues of Public Health
The Client will comply with the following safety protocol:
(1) Ensure all guests are following public health guidelines set by local, state, or federal governments.
(2) Make sure the event’s capacity and location are in compliance with all local, state, or federal public health guidelines.
(3) If the Client requires contracted entertainers to wear a mask or abide by any specific protocol in the interest of public health, they must notify Arty Party via email at the time of booking.
(4) The Client will act in good faith and notify Arty Partyand any contracted entertainers of any event guests who are known to have tested positive for covid-19 or any other illness as a matter of public health.
(5) The Client will accept that a contracted entertainer may refuse to render services to event guests who show signs of illness. Symptoms include but are not limited to: coughing; running nose/eyes; visible fever or fatigue; visible rash; open wounds. The Client will not take any action against Arty Party or its contracted entertainers for refusing to render services to event guests who show signs of illness.
(6) If a contracted entertainer chooses to wear a mask and/or face shield for any reason, the Client may not ask the entertainer to remove their mask or face shield.
(7) The Client shall notify Arty Party immediately of any threats of violence or destruction pertaining to the event that would make rendering of services illegal, impossible, or reasonably impractical such as but not limited to war, terrorism, protests, harassment, strikes or threat of strikes, the destination’s appearance on a US State Department Advisory list; or verified serious illness.

Arty Party and its contracted entertainers will comply with the following:
(1) If the Client notifies Arty Party of any safety protocol in the interest of public health at the time of booking, Arty Party and its contracted entertainers will follow the Client’s safety protocols.
(2) Any contracted entertainer may choose to wear a mask and/or face shield for any reason.
(3) Arty Party and its contracted entertainers will use their professional judgment when working with guests and may refuse to render certain services (including but not limited to face painting and temporary tattoos) to event guests who show signs of illness in the interest of public health.
(4) Arty Party will act in good faith and notify the Client of any entertainers who are known to have tested positive for covid-19 or any other illness as a matter of public health.

Safe working conditions
The Client agrees to comply with the following safety protocol to ensure safe work environments for Arty Party and all contracted entertainers:

1. For weather under 55°F, all entertainers must be placed indoors or in an enclosed and heated tent.
2. For weather over 70°F, all entertainers must be placed in the shade.
3. Over 85°F, the entertainers may request to be moved to an indoor space with AC if they begin to feel symptoms of heat sickness.
4. Entertainers may not be hit or touched by anyone (including children) without their consent.
5. Event guests may not threaten entertainers, verbally or otherwise.
6. Event guests may not make any sexual remarks or gestures toward entertainers.
7. In the case where an event guest creates an uncomfortable or unsafe working environment for any contracted entertainer, the Client is responsible for removing the guest from the area near the entertainer or the event entirely.
8. In the case of a local air quality rating of 101+ as issued by the EPA (Unhealthy for Sensitive Groups; Unhealthy; Very Unhealthy; or Hazardous), the Client is responsible for placing all entertainers to an indoor area. Air quality ratings may be found at (link hidden)

It is our goal to provide the safest possible events for the Client, event guests, and contracted entertainers. If there is any safety issue at your event call our emergency line so Arty Party can rectify it right away.

Additional safe working conditions for costumed characters and circus entertainers
The Client agrees to comply with the following additional safety protocol to ensure safe work environments for Arty Party and all contracted entertainers working as costumed characters or circus entertainers.

8. For outdoor events, all costumed characters must be kept in the shade at all times regardless of outdoor temperature.
9. Mascot characters and stilt walkers need a 15min break for every 45min of work in an area where they cannot be seen by party guests and can take off their stilts or costumes.
10. All costumed characters may require a heat break regardless of event location or temperature if they begin to feel signs of overheating or cold in order to prevent serious medical conditions such as heat stroke, frostbite, or hypothermia.
11. Every mascot entertainer MUST have an event volunteer organized by the Client to be the mascot’s assistant or “handler”. For corporate or nonprofit events this should be a staff member or volunteer. For a birthday party or private family event, this should be the Client.
12. The mascot entertainer's assistant or handler, as organized by the Client, cannot leave the entertainer’s direct side and must be within arm's reach for the entirety of contracted entertainment time.
13. A mascot, character, or stilt walker may leave the event if the handler is absent and cannot control children (i.e.: excessive hitting or pushing) for the entertainer’s own safety. (See following: “failure to comply with safety”).
14. If any damage happens to the costume at an event due to a lack of handlers or insufficient handlers, the Client is responsible to pay for damages or a new costume.

It is our goal to provide the safest possible events for the Client, event guests, and contracted entertainers. If there is any safety issue at your event call our emergency line so Arty Party can rectify it right away.

AI and media use
The Client agrees that no photos or videos taken during the event shall be used in a manner that alters, misrepresents, or exploits the likeness of Arty Party's contracted entertainers. This includes, but is not limited to, the use of AI or other digital technologies to modify, enhance, or manipulate images or videos in any way that could be harmful, defamatory, or invasive of privacy.

The Client agrees not to use any AI applications that can in any way modify the appearance of individuals in photos or videos taken during the event. Any such use will be considered a violation of this contract and will result in legal action.

Additional safe working conditions for foam parties
The Client agrees to comply with the following additional safety protocol to ensure safe work environments for Arty Party and all contracted foam technicians.

15. The Client is responsible for overseeing the safety of all foam parties. This may include paid childcare staff, parent volunteers, lifeguards, security guards, emergency responders, or other representatives of the Client. It is the Client’s responsibility to remove any guests of any age who are acting in an unsafe way from the event. The Client understands that foam technicians are not trained in First Aid or CPR should the need arise. If any guests are injured during an event hosted by the Client, the Client assumes all legal responsibility and will hold Arty Party harmless.
16. Foam machine must be operated over a smooth, compatible surface such as lawn, sports turf, or hard top. The foam machine may NOT be operated on rough surfaces such as but not limited to sand, mulch, rocks, or brick. The surface may NOT contain any protruding objects such as brick, rocks, glass, stumps, playground equipment, sports equipment, or any jagged objects. The foam machine may NOT be used near any body of water including but not limited to pools, ponds, fountains, creeks, rivers, lakes, or beaches. The Client understands that a failure to provide a suitable space for foam entertainment may cause physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. The Client assumes all legal responsibility and will hold Arty Party harmless.
17. Foam machines cannot be operated in rain; winds over thirteen (13) miles per hour; snow; hail; lightning or thunder; and other unsuitable weather conditions. If the foam technician pauses foam production for a portion of the scheduled event because of changing weather conditions, the Client will still be charged for the scheduled time as agreed upon at booking.

Failure to comply with safety
If a contracted entertainer is placed in unsafe working conditions (either judged by the entertainer themselves or local, state, or federal guidelines) the entertainer may speak with the Client to improve event safety. However, if the Client cannot be contacted and/or does not or cannot adhere to safe working conditions, the contracted entertainer may leave an event. The Client agrees to forfeit any deposits or payments made to Arty Party in the case of an entertainer leaving and will hold Arty Party harmless.
